These terms form a binding agreement when you use Pay4books. Additional author, publisher, subscription, institutional, payout, promotional, or product-specific terms may also apply.
These Terms of Use govern access to and use of Pay4books, including the website, user accounts, marketplace, wallet, checkout, protected reader, library, author and publisher tools, subscriptions, support services, and related features.
1. Acceptance of these terms
By visiting Pay4books, creating an account, buying or accessing content, funding a wallet, submitting a manuscript, publishing a book, receiving royalties, or otherwise using the platform, you agree to these Terms of Use and the policies incorporated by reference. If you do not agree, do not use the platform.
If you use Pay4books for an organisation, you represent that you have authority to bind that organisation. Additional author, publisher, institutional, subscription, payout, or promotional terms may apply to specific services.
2. About Pay4books
Pay4books is a Nigerian digital reading, publishing, and book-commerce platform operated by Pathwalker Publishing Limited. It provides technology and services that may enable readers to discover and purchase books, access protected digital content, maintain a library, fund a wallet, subscribe to content, and interact with authors, publishers, and institutions.
Unless Pay4books is expressly identified as the seller or publisher of a title, the relevant author, publisher, or merchant remains responsible for rights ownership, content accuracy, and obligations assigned to them by law or agreement.
3. Eligibility and authority
You must have legal capacity to enter a binding agreement or use the platform under the supervision and authority of a parent, guardian, school, institution, or authorised representative. You may not use Pay4books where access is prohibited by applicable law.
4. Accounts and security
- Provide accurate, current, and complete information.
- Keep passwords, email accounts, OTPs, wallet PINs, and devices secure.
- Do not share accounts or allow unauthorised persons to use your access.
- Notify Pay4books promptly if you suspect account compromise or unauthorised activity.
- You are responsible for activity carried out through your account unless applicable law provides otherwise.
Pay4books may require identity, email, telephone, payout, author, publisher, or institutional verification before enabling particular features.
5. Marketplace listings and availability
Book descriptions, covers, formats, prices, stock, delivery information, previews, author details, and availability are provided by Pay4books, authors, publishers, or other authorised parties. We aim for accuracy but cannot guarantee that every listing is complete or error-free. We may correct errors, update information, withdraw listings, restrict access, or cancel an affected transaction where reasonably necessary.
6. Prices, taxes, fees, and currency
Prices are displayed in the stated currency and may change before an order is completed. The checkout page shows the amount payable, including applicable delivery charges, discounts, platform fees, taxes, or other charges made known before confirmation. A pricing error does not require Pay4books or a seller to complete a transaction at an obviously incorrect price, subject to applicable consumer law.
7. Orders and payment
An order is an offer to purchase. An order becomes accepted when payment is verified and the order is confirmed or fulfilled. Pay4books may use third-party payment processors. Payment authorisation does not always mean final settlement, and an order may remain pending while a transaction is verified.
Do not send card PINs, CVVs, banking passwords, OTPs, or full card details to Pay4books staff or through support messages. Payment providers process sensitive payment credentials under their own terms.
8. Wallets
Where enabled, a Pay4books wallet may hold value or credits for eligible platform transactions. Wallet balances are not bank deposits, do not earn interest, and are not legal tender. Reader wallet balances are generally intended for purchases and may not be withdrawable unless the applicable wallet rules expressly allow withdrawal.
Wallet funding, reversals, refunds, security controls, limits, expiry, transfer restrictions, and account clearance may be governed by additional rules. Pay4books may place a temporary hold on wallet activity where fraud, error, chargeback, account compromise, or legal risk is suspected.
9. Digital content and access licences
When you purchase or receive access to an ebook, audiobook, protected reader title, course-like book resource, subscription title, or other digital content, you receive a limited, personal, non-exclusive, non-transferable, and revocable right to access the content for lawful personal use, subject to the product description and these terms.
Buying digital access does not transfer copyright or ownership of the underlying work. You may not copy, reproduce, extract, screen-record, scrape, resell, redistribute, upload, broadcast, share login access, circumvent access controls, or create unauthorised derivative works except where expressly permitted by law or written licence.
10. Protected online reading
Some titles may be available only inside the Pay4books protected reader and may not include an ordinary downloadable file. Access may require an active account, supported browser, internet connection, valid purchase, subscription, institutional assignment, or other permission.
Pay4books may use account-linked permissions, reading logs, watermarks, access limits, device or session controls, and other safeguards. Attempts to bypass or interfere with these controls may result in suspension or termination.
11. Physical books, delivery, and risk
For physical products, delivery times are estimates unless expressly guaranteed. Delivery may depend on stock, destination, courier performance, weather, security, public holidays, and accurate customer information. Risk and title pass as provided by applicable law and the stated delivery terms.
Inspect delivered items promptly. Report missing, damaged, defective, or incorrect products through the support system with the order reference and evidence reasonably requested.
12. Cancellations, returns, and refunds
Refund and cancellation eligibility depends on the product type, transaction status, delivery stage, access already supplied, subscription terms, seller obligations, and applicable consumer law.
- Duplicate charges, failed fulfilment, verified payment errors, and materially defective products may qualify for correction, replacement, reversal, or refund.
- Digital content that has already been accessed, downloaded where permitted, streamed, or substantially consumed may be non-refundable except where required by law or where the content is defective or materially misdescribed.
- Physical returns may require the item to be returned within the stated period and in an acceptable condition, subject to statutory rights.
- Promotional, subscription, or institutional purchases may have additional cancellation conditions disclosed before purchase.
Nothing in these terms excludes a mandatory consumer right under the Federal Competition and Consumer Protection Act or other applicable law.
13. Subscriptions and recurring services
A subscription provides access to the features, catalogue, limits, or services described for the selected plan. Plans may be monthly, annual, promotional, institutional, author, publisher, or reader plans. Unless stated otherwise, access continues for the paid term and may renew where recurring billing has been authorised.
You are responsible for cancelling before the next billing date where automatic renewal applies. Downgrades, upgrades, usage limits, rollover, expiry, catalogue changes, and refunds follow the terms displayed for the plan.
14. Author and publisher responsibilities
By submitting or publishing content, an author, publisher, or authorised representative represents and warrants that:
- They own or control the rights needed to submit, publish, distribute, sell, promote, and licence the content.
- The submission does not infringe copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights.
- Book metadata, pricing, descriptions, contributor information, rights statements, and payout details are accurate.
- The content does not contain unlawful material, malware, deceptive claims, or prohibited content.
- They will comply with applicable publishing, advertising, tax, consumer, and content laws.
Pay4books may review, request corrections, reject, suspend, unpublish, or remove content. Review or approval does not transfer responsibility for the content or guarantee sales.
15. Licence granted by authors and publishers
To operate the service, a submitting rights holder grants Pay4books the rights described in the applicable author or publisher agreement. These may include the right to host, reproduce for technical delivery, format, convert, display, preview, promote, distribute, sell, provide protected access, generate thumbnails or metadata, and use submitted branding for platform operations.
The scope, territory, term, exclusivity, commission, royalty, takedown, and post-termination obligations are governed by the specific publishing agreement. Where there is a conflict, the signed or accepted author or publisher agreement controls for that subject.
16. Royalties, commissions, and payouts
Royalty calculations depend on eligible net sales, listed price, discounts, taxes, payment charges, platform commission, refunds, chargebacks, promotions, institutional arrangements, and the applicable agreement. Dashboard figures may be provisional until transactions clear and reconciliation is complete.
Payouts may require verified identity, accurate bank details, minimum thresholds, completed tax or compliance information, and resolution of disputes or chargebacks. Pay4books may withhold or adjust disputed, fraudulent, refunded, duplicate, or legally restricted amounts.
17. Reviews, comments, and user contributions
You may post only honest, relevant, lawful, and non-infringing reviews or contributions. Do not post harassment, hate content, threats, confidential information, impersonation, spam, paid manipulation, false allegations, or content unrelated to the product or service.
You grant Pay4books a non-exclusive licence to host, display, moderate, reproduce, and use submitted reviews or contributions for platform operation and promotion. We may remove or restrict content that violates these terms.
18. Prohibited conduct
You must not:
- Break the law or encourage unlawful conduct.
- Infringe intellectual-property, privacy, confidentiality, or contractual rights.
- Commit fraud, abuse promotions, initiate improper chargebacks, or manipulate wallet, royalty, review, or referral systems.
- Upload malware, interfere with platform availability, probe security, or attempt unauthorised access.
- Scrape, crawl, harvest, reverse engineer, or automate access except with written permission or lawful search-engine indexing.
- Share protected content, accounts, access links, sessions, or credentials.
- Misrepresent identity, authority, authorship, publishing rights, transactions, or affiliations.
- Use the platform to distribute deceptive, defamatory, exploitative, obscene, violent, hateful, or otherwise prohibited content.
19. Intellectual property
Pay4books technology, branding, interface, databases, software, design, text, graphics, and platform-created materials are owned by or licensed to Pay4books and are protected by applicable intellectual-property law. These terms do not grant rights to use Pay4books trademarks or platform materials except as necessary for ordinary use of the service.
Books and related content remain protected by the rights of their authors, publishers, or other rights holders.
20. Copyright complaints
A rights holder who believes content on Pay4books infringes their rights should submit a clear notice identifying the protected work, the allegedly infringing material and URL, the basis of ownership or authority, contact details, and a good-faith statement. Pay4books may remove or restrict content while assessing a complaint and may request further evidence.
Knowingly false or misleading complaints may create liability. Users whose content is affected may be allowed to respond where appropriate.
21. Third-party services and links
Pay4books may integrate payment gateways, authentication providers, couriers, analytics tools, hosting services, social networks, or third-party websites. We are not responsible for independent services outside our control. Their own terms and privacy notices apply.
22. Platform changes and availability
We may add, modify, suspend, restrict, or discontinue features, plans, categories, payment methods, supported devices, or content where reasonably necessary. We do not guarantee uninterrupted or error-free access. Planned maintenance, emergencies, internet failure, provider outages, security incidents, and events beyond reasonable control may affect availability.
23. Suspension and termination
Pay4books may restrict, suspend, or terminate access where reasonably necessary to address a breach, fraud, piracy, security risk, unlawful conduct, payment dispute, repeated complaint, legal requirement, or harm to users or the platform. Where appropriate, we may give notice and an opportunity to remedy the issue.
You may stop using the service and request account closure, subject to retention of records needed for transactions, publishing agreements, royalties, legal obligations, fraud prevention, or dispute resolution.
24. Disclaimers
To the extent permitted by law, Pay4books is provided on an βas availableβ basis. We do not guarantee that every book, statement, review, author claim, or third-party listing is accurate, suitable, or complete. Content is provided for reading, educational, inspirational, professional, or general informational purposes and is not a substitute for personalised legal, medical, financial, or other regulated professional advice.
No statement on the platform guarantees sales, income, audience growth, publishing approval, uninterrupted access, or a particular outcome.
25. Limitation of liability
Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, Pay4books and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss, loss of profit, loss of data, loss of opportunity, or loss caused by third-party services, unauthorised account access, or events beyond reasonable control.
Where liability can lawfully be limited, aggregate liability arising from a specific paid transaction will not exceed the amount paid to Pay4books for that transaction during the twelve months before the claim, unless applicable law requires a different remedy.
26. Indemnity
To the extent permitted by law, authors, publishers, institutions, and other business users agree to defend, indemnify, and hold Pay4books harmless from third-party claims, losses, and reasonable costs arising from their submitted content, infringement, unlawful conduct, breach of representations, tax obligations, or violation of these terms. This provision does not apply where the claim results from Pay4books' own unlawful conduct or where applicable law prohibits the indemnity.
27. Consumer rights
These terms must be read consistently with the Federal Competition and Consumer Protection Act, applicable data-protection law, and other mandatory Nigerian consumer protections. If a provision conflicts with a right that cannot lawfully be waived, the mandatory right prevails.
28. Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. Before filing a claim, the parties should attempt in good faith to resolve the matter through the Pay4books support process. The parties may agree to mediation or arbitration. Where a dispute is not resolved, it may be brought before a court of competent jurisdiction in Nigeria.
29. Changes to these terms
We may update these terms to reflect changes in law, services, technology, or business operations. The current version and effective date will be published on this page. Where a material change requires notice or renewed acceptance, Pay4books may provide an account, email, or platform notice.
30. General provisions
If a provision is held invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without written permission. Pay4books may transfer its rights and obligations as part of a lawful restructuring, financing, merger, acquisition, or transfer of business.
